These Terms and Conditions ("Terms") govern your access to and use of the Website, including the purchase of access to a printable report card generated from user-submitted data (the "Service"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

By accessing or using the Website or purchasing the Service, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Website on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Nature of the Service and Disclaimer

The Service is intended as a fun, make-believe analysis for entertainment purposes only. The report card generated by the Website compares user-submitted data to fictional or humorous characteristics of apes and is not based on any real scientific similarity between the user and the identified ape. Modularity AS makes no claims regarding the accuracy, validity, or scientific basis of the report card results. You acknowledge that the Service is provided for amusement and should not be relied upon for any factual or scientific purposes.

3. Description of Service

The Website allows users to submit personal data to generate a printable report card for entertainment purposes. The report card is a fictional, humorous analysis and does not reflect scientifically accurate information. Access to the report card is provided upon payment of the applicable fee. You are responsible for ensuring the accuracy and completeness of the data you submit.

4. Eligibility

You must be at least 18 years old to use the Website or purchase the Service, unless you have verifiable parental consent as required by applicable laws, including the General Data Protection Regulation (GDPR) and the Norwegian Personal Data Act. If the Service involves data related to minors, parental consent must be provided for users under 16 for data processing and under 18 for contractual purposes.

5. User Data and Consent

• Data Submission: You agree to provide accurate, complete, and lawful data for the generation of the report card. You are solely responsible for the content of the submitted data.

Consent is obtained separately via a clear affirmative action (e.g., a checkbox) and is not bundled with these Terms, in compliance with GDPR.

6. Payment and Access

• Fees: Access to the printable report card requires payment of a fee, as displayed on the Website. All fees are non-refundable unless otherwise required by Norwegian consumer protection laws.
• Errors in Pricing: We reserve the right to cancel orders if the listed price is incorrect due to an error.
• Access: Upon successful payment, you will receive a one-time access link to a page formatted to enable you to print the report card. This link may expire after a specified period.

7. Intellectual Property

The Website and its content, including the design and layout of the report card, are owned by Modularity AS and protected by copyright laws. You are granted a limited, non-exclusive, non-transferable license to download and print the report card for personal, non-commercial use. You may not reproduce, distribute, or create derivative works from the report card or any Website content without our prior written consent.

• Use the Website or Service for any illegal purpose or in violation of these Terms.

9. Limitation of Liability

Our total liability shall not exceed the amount paid for the Service.

10. Indemnification

You agree to indemnify and hold Modularity AS harmless from any claims, losses, or damages arising from your use of the Website, your submitted data, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Website or Service at our discretion if you violate these Terms or engage in prohibited activities. Upon termination, you must cease using the Service and will lose access to any generated report cards.

These Terms are governed by the laws of Norway. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to mediation or arbitration in Norway.

We may update these Terms from time to time. The updated Terms will be posted on the Website with the “Last Updated” date. Continued use of the Website after changes constitutes your acceptance of the new Terms.
